Michigan Child Support Law

Under Michigan law, a parent may be ordered to provide financial, medical, educational and other support for any child under the age of 18 or who is older than 18 but still attending school full-time. Once the child is 19-and-half, however, support no longer is required. A court will calculate the amount of child support by using the Michigan Child Support Guidelines, which are issued by the Friend of the Court Bureau. The court will consider the following factors:

  • Both parents’ individual net income
  • The number of children the parent must support
  • The amount of time the parent spends with the child; and
  • The different costs for the child, such as childcare and school.

Child support payments cannot be modified unless the parent shows a change in circumstances, such as a loss of income or a change in the receiving parent’s life, such as remarriage or cohabitation.

Many child support cases become complicated when one person is self employed or has income generating property that is hard to value. In order to avoid overpaying or underpaying those assets and income sources must be properly evaluated. Over the span of a childhood large amounts of money are at stake. A parent who fails to make child support payments may face felony criminal charges and civil penalties.

The parent will be responsible to provide the child support even if the child and other parent move to another state. However, the child support order will need to be registered in that state and could be altered due to changes in the parenting time schedule that go along with a move out of state.
